EPS Criticizes Tamil Nadu Government for Delay in Declaring Ponmudy’s Seat Vacant

Chennai: The AIADMK, the principal opposition party in the Tamil Nadu Assembly, has raised concerns over the delay in declaring the Thirukoyilur constituency, represented by former minister K Ponmudy, vacant following a court verdict. Former AIADMK ministers Thalavai N Sundaram and C Vijaya Baskar met with Assembly secretary K Srinivasan to address the issue, urging prompt action from Speaker M Appavu.

Expressing dismay over the delay, the former ministers highlighted the swift action taken in declaring the Vilavancode Assembly constituency vacant, previously held by former Congress MLA S Vijayadharani. They emphasized the urgency of the matter, underscoring the need for consistency in administrative decisions.

In a letter submitted by AIADMK leader of the opposition Edappadi K Palaniswami, Ponmudy’s conviction under the Prevention of Corruption Act, 1988, was cited as grounds for his disqualification. The Madras High Court’s verdict on December 21, 2023, found Ponmudy guilty of possessing assets disproportionate to his known sources of income, with no stay order issued by the Supreme Court.

Palaniswami reiterated that as per the Representation of People Act, individuals convicted under the Prevention of Corruption Act, 1988, are ineligible to hold office in the Assembly. While Section 8(4) of the Representation of the People Act allows disqualified members to appeal their disqualification, the legality of this provision was nullified by the Supreme Court in the Lily Thomas vs. Union of India case.

The AIADMK’s insistence on immediate action reflects growing impatience with the delay in addressing Ponmudy’s disqualification. The party emphasizes the importance of upholding ethical standards and ensuring accountability among elected representatives.
